Rochelle Henderson forwarded your records request to me because it was unclear to her whether the records requested are public records. The District permit condition you note requires Pacific Steel Castings to maintain certain records at its site. Virtually all regulatory agencies require record keeping by regulated entities. The agencies do not have the resources to maintain this vast volume of information, but use on-site records as necessary for enforcement purposes.

If on-site records are obtained by a California agency and are used in the course of its work, they may become public records subject to disclosure through the Public Records Act, provided the various exemptions in the act do not apply. In this case, the records you seek were not prepared by the District, are not in its possession or control, and have not been obtained or used by the District. As a result, the records are not public records subject to the California Public Records Act.

I am interested in viewing the compliance records for Pacific Steel Castings at 1333 Second Street Berkeley CA 94710, as described below. I saw no where to include this detail within the attached request. Please call me if you have any problems with understanding my request. You may want to know that the records I seek are most likely at Pacific Steel Castings, and further, that I have been denied access to the property in the past.
